Terms & Conditions

  1. This promotion is only open to UK residents, aged over 18, excluding employees of the Promoter and all those professionally associated with this promotion.
  2. Promotion Period: Entries must be made between 00.01 on 1st August 2015 and 11.59pm on 31st December 2015. Within this period, there will be 4 monthly periods, each closing at 11.59 on the last calendar day of each month.
  3. To Enter: simply log into your Instagram account and upload a photo of you and one or more friend(s) and include the hashtag #remarkablefriends. Entries must include the hashtag and be in accordance with clauses 7 and 16 to be valid.
  4. Maximum of one entry per person per month will be permitted.
  5. A maximum of one prize per person may be won across the whole Promotion Period.
  6. No purchase is necessary; however, internet access and a valid Instagram account are required.
  7. Further entry details:
    1. Entrants must only submit images that are their own work;
    2. Entrants must only upload images that do not infringe or violate the rights of any third party, including but not limited to, ownership, copyrights, trademarks, patents, logos, licensing rights, rights of publicity or privacy or any other intellectual property rights; and
    3. By entering, entrants confirm that they have obtained the consent of any person that appears in the photo that has been uploaded.
  8. The person that uploads the photo to Instagram is considered to be the entrant; any other person in the photo will not have any rights to the prize.
  9. The Prizes: For each monthly period, one entrant will win 1 x Hatbox full of packs of Thomas J Fudge’s biscuits including personalised packs which have been personalised with the winners’ and their friends’ names.
  10. Winner Selection: Each monthly period, a winner will be selected by a panel of judges containing at least one independent member from PromoVeritas, the independent promotional verification service. Judging will take place within 10 days of the relevant closing date. The entries will be judged according to the following criteria:
    1. Creativity and originality of the image;
    2. Portrayal of friendship in the image;
    3. Composition and technical quality of the image.
  11. Each monthly period winner will be contacted by direct message on Instagram within 7 days of the relevant judging. In the event that a winner is not contactable following reasonable efforts or has not responded within 28 days of notification to confirm acceptance of the prize then the promoter reserves the right to reallocate the prize to the entrant with the next best entry selected in the same manner.
  12. Please allow up to 28 days for delivery of the prizes from prize acceptance.
  13. The prizes must be taken as stated and no compensation will be payable if a winner is unable to use the prizes as stated. No cash alternative is available and once confirmed, the prizes are non-transferable or refundable.
  14. The Promoter reserves the right to substitute the prizes for prizes of an equal or greater value if, for any reason, the original items are unavailable.
  15. Entries will be rejected if they:
    1. have not been uploaded specifically for the promotion;
    2. contain defamatory, malicious, indecent or other inappropriate content including sexist or racist language or imagery;
    3. include the names, likenesses, photographs or similar of any individual without their express permission;
    4. contain immoral or obscene behavior;
    5. condone or encourage violent or anti-social behaviour;
    6. cause offence on the ground of religion, gender, sexual orientation, nudity, disability or age;
    7. have negative attitudes or thoughts about the promoter or any of its related partners; and
    8. represent a danger, health and safety fear or distress.
  16. By entering, winners agree that if they win, they will participate in any reasonable publicity arranged by the Promoter or its agencies.
  17. By entering the promotion, entrants confirm that they have read and agree to be bound by these terms & conditions and by the decisions of the Promoter, which are final in all matters relating to the promotion. Failure to do so will result in the forfeiture of the prize. No correspondence will be entered into.
  18. The Promoter or its agencies accept no responsibility for any loss, injury or damage suffered through acceptance of the prize.
  19. The Promoter or its agencies will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of The Promoter or its agencies. Proof of submission of entry is not proof of receipt of entry.
  20. The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these conditions or the spirit of the promotion.
  21. The Promoter accepts no responsibility for system errors or other issues that may result in lost, delayed or not received registrations or winner notifications.
  22. This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. Entrants understand that they are providing their information to the Promoter and not to Instagram, and that Instagram has no liability for any element of this promotion.
  23. The winners’ names and counties will be available by sending a stamped self-addressed envelope to Fudge’s Instagram Monthly Prize Draw Winners List, PO Box 95, Leigh, Lancs, WN7 1WS for a period of one month following the end of the relevant draw.
  24. All entries must be made directly by the person entering the promotion. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, entries via third parties or syndicates, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrants is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the competition in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.
  25. Aside from the use of entry data for the performance of the competition and administration of this promotion, the Promoter will not use personal data for any other purpose without the express consent of the entrant. See www.thomasjfudges.co.uk/legal for the Promoters full privacy policy.
  26. To the full extent permitted by law the Promoter will not accept liability for any loss, damage, injury or death arising from this promotion beyond its reasonable control.
  27. Any question concerning the legal interpretation of the rules will be based on English and Welsh law and the Courts of England and Wales will have exclusive jurisdiction.
